Terms of Service
Welcome to Zephyra Studio. By accessing our website and using our services, you agree to comply with and be bound by the following terms and conditions. Please read them carefully before initiating any project or purchase.
1. Description of Services
Zephyra Studio provides professional web design and development services, system maintenance, and the sale of pre-built software solutions delivered as executable (.exe) files. All services are performed according to the specifications agreed upon prior to the start of the project.
2. Web Development Process and Payments
For custom web development projects, the standard payment model requires a 50% non-refundable deposit before work commences, with the remaining 50% due upon project completion and client approval. Depending on the selected package, the client is entitled to up to 5 design revisions. Any additional revisions or significant changes outside the initial scope may incur extra charges.
Promotional Packages and Maintenance
Under specific promotional offers, the client pays a fixed setup fee for the website and commits to a monthly maintenance plan for a minimum duration of 24 months. Early termination of this agreement before the 24-month period expires may result in penalties as defined in the individual service contract.
3. Software Sales and Delivery
Software products are delivered in digital format as .exe files. Zephyra Studio is responsible for delivering a functional file but is not obligated to perform installation, configuration, or manual execution of the software on the client’s local machine, unless specifically agreed upon and billed at a daily support rate.
4. Strict No-Refund Policy
Due to the digital nature of our products and the custom-made nature of our services, Zephyra Studio operates under a strict No-Refund Policy. Once the development process has started or the software file has been delivered/downloaded, no refunds will be issued. By making a payment, the client acknowledges satisfaction with the proposal and waives the right to a refund. We remain available to fix technical bugs or errors within a reasonable timeframe as part of our support commitment.
5. Intellectual Property and Ownership
Ownership of the website code and design is transferred to the client only after full payment of the agreed amount. Zephyra Studio retains administrative access to the website for the purpose of regular maintenance, security updates, and bug fixes, unless the client explicitly requests otherwise after all contractual maintenance obligations have been met.
6. Limitation of Liability
While Zephyra Studio strives to ensure all products are secure and functional, we are not liable for any indirect damages, data loss, or issues arising from improper use of the software by the client or third-party factors (such as hosting providers or third-party plugins).
7. Governing Law
Any disputes arising from these terms that cannot be resolved through mutual agreement shall be subject to the jurisdiction of the courts in Serbia.
